339. With respect to General License (GL) D-2 authorization in paragraph (a)(3), do exporters need to make a determination as to whether an export of an item or service listed in the Annex to GL D-2 is “incident to communications”?

No.  The Annex lists software, hardware, and related services determined to be “incident to communications” for purposes of the authorization in paragraph (a)(3) of GL D-2.
