TREASURY DIRECTIVE 16-15

SUBJECT: Delegation of Authority for Issuing Certain Regulations, Including Notices, Generated by the Bureau of the Fiscal Service

  1. DELEGATION.
    1. By virtue of the authority vested in the Fiscal Assistant Secretary by Treasury Order 101-05, I hereby delegate to the Commissioner of the Bureau of the Fiscal Service authority to issue, without formal clearance by the Departmental Offices (excepted as noted below), regulations, including notices, generated by the Bureau of the Fiscal Service that, in the judgment of the Commissioner:
      1. 1) do not have significant political interest or a significant economic impact; and
      2. 2) do not establish new and significant policy or have broad policy implications.
        1. a) The Commissioner of the Bureau of the Fiscal Service shall sign any such regulations, including notices, under this authority in that official's capacity and under that official's title.
        2. b) The Commissioner of the Bureau of the Fiscal Service shall be responsible for referring to the Fiscal Assistant Secretary any matter on which action shall appropriately be taken by the Fiscal Assistant Secretary.
        3. c) This delegation does not modify any requirements or procedures concerning the submission of a regulation and related documents to the Office of Management and Budget through the Department's Office of General Counsel, or the review of a regulation by the Department's Office of General Counsel for compliance with the various statutes, Executive Orders, and policies that govern the regulatory process.
  2. SCOPE. This directive applies to all bureaus, offices, and organizations in the Department of the Treasury, including the offices of inspectors general within the Department. The provisions of this order shall not be construed to interfere with or impede the authorities or independence of the Department’s Inspector General, the Treasury Inspector General for Tax Administration, or the Special Inspector General for the Troubled Asset Relief Program.
  3. REDELEGATION. This authority may not be redelegated by the Commissioner of the Bureau of the Fiscal Service.
  4. AUTHORITY. Treasury Order 101-05, "Reporting Relationships and Supervision of Officials, Offices and Bureaus, Delegation of Certain Authority, and Order of Succession in the Department of the Treasury."
  5. CANCELLATION. Treasury Directive 16-15, “Delegation of Authority for Issuing Certain Regulations, Generated by the Financial Management Service,” dated July 9, 2019 is superseded.
  6. OFFICE OF PRIMARY INTEREST. Office of the Fiscal Assistant Secretary and Office of the Commissioner of the Bureau of the Fiscal Service.
