Federal Interagency Task Force on Long-Term Care Insurance

Background

The Department of the Treasury (Treasury) convened the Federal Interagency Task Force on Long-Term Care Insurance (Task Force) in response to recommendations in Treasury’s October 2017 Report on Asset Management and Insurance (the Report).  The Report is linked here (see pp. 143-144).  The Report identified the challenges of financing long-term care as a matter of national interest requiring a coordinated response from the federal government, and directed the Task Force to develop policies at the federal level to complement reforms at the state level relating to the regulation of long-term care insurance (LTCI).  The Report further directed the Task Force to coordinate with state insurance regulators and the National Association of Insurance Commissioners (NAIC).  The Task Force is chaired by Treasury’s Assistant Secretary for Economic Policy Michael Faulkender, and its members include representatives from the Department of Health and Human Services, the Centers for Medicare & Medicaid Services, the Internal Revenue Service, the Office of Management and Budget, the Department of Labor, and the Office of Tax Policy and the Federal Insurance Office within Treasury. 

Work of the Task Force

The Task Force has been reviewing various proposals to reform federal laws and regulations relating to regulation of LTCI, including the federal policy options presented to Congress for its consideration by the NAIC in April 2017 (available here).  The Task Force has consulted with a range of stakeholders, including trade groups, insurance companies and insurance product distributors, consumer and other advocacy groups, actuaries, academics, legal experts, state insurance regulators and the NAIC, and others with relevant knowledge.  The Task Force has also reviewed data, research, and published materials from private and public sources.

On July 25, 2019, following a notice posted to this website on July 18, 2019, the Task Force held a public meeting with selected stakeholders at the Department of the Treasury, 1500 Pennsylvania Avenue, Washington, D.C.  Topics discussed at the meeting included the social need for long-term supports and services, the individual private LTCI market, employer, group, and worksite products, state regulation of LTCI, the federal government and LTCI, and federal-state partnerships and other financing approaches.    

Invitation for Public Comment

Members of the public wishing to comment on the business of the Task Force are invited to submit written statements.  In particular, the Task Force welcomes comments on potential reforms to federal laws, regulations, and policies to complement reforms at the state level relating to the regulation of long-term care insurance.  Written statements may be submitted by either of the following methods:
