DATE:  October 29, 2008

SUBJECT: Designation of "Head of Agency" for Procurement Matters

  1. DELEGATION.  Pursuant to the authority vested in me as Secretary of the Treasury, I hereby delegate to the Assistant Secretary for Management and Chief Financial Officer all duties, powers, rights and obligations of the Secretary of the Treasury with respect to procurement of supplies and services. The authorities delegated under this Order shall be exercised in accordance with the limitations and requirements of all applicable statutes and regulations.
  2. REDELEGATION.  The authorities delegated under the Order to the Assistant Secretary for Management and Chief Financial Officer may be redelegated to appropriate officials.
  3. DESIGNATION.  The Assistant Secretary for Management and Chief Financial Officer is designated to act as Head of the Agency with respect to procurement.
  4. RESPONSIBILITIES.  The responsibilities of the Assistant Secretary for Management and Chief Financial Officer under this Order include, but are not limited to:
    1. Prescribing regulations, directives and other guidance pertaining to procurement, and publishing, when appropriate, such issuances in 48 CFR Chapter 10 or elsewhere;
    2.  Appointing contracting officers for the United States; and
    3. Making, to the extent permitted by law, all determinations and findings required by statute or regulation to be made by the Head of the Agency.
  5. AUTHORITIES.
    1. Title III of the Federal Property and Administrative Services Act of 1949 (63 Stat. 377, 393), as amended (41 USC Chapter 4).
    2. 31 USC 321(b).
  6. CANCELLATION.  Treasury Order 101-30, "Designation of "Head of Agency" for Procurement Matters", dated October 21, 1999, is superseded.
  7. OFFICE OF PRIMARY INTEREST.  The Office of the Procurement Executive, Office of the Assistant Secretary for Management and Chief Financial Officer.
