TREASURY ORDER 102-17

SUBJECT: Delegation of Authority Concerning the Personnel Security Program

  1. PURPOSE. This Order establishes the delegation of authorities related to the senior agency official responsible for directing and implementing a personnel security program in the Department.
  2. SCOPE. This Order applies to all bureaus, offices, and organizations of the Department of the Treasury, including the offices of Inspectors General, within the Department.  The provisions of this Order shall not be construed to interfere with or impede the authorities or independence of the Treasury Inspector General, the Treasury Inspector General for Tax Administration, or the Special Inspector General for the Troubled Asset Relief Program.
  3. DELEGATION. By virtue of the authority vested in the Secretary of the Treasury, including the authority vested by 31 U.S.C. 321(b), it is ordered that:
    1. The Department shall maintain a personnel security program to fulfill the responsibilities imposed by 5 U.S.C. 7531-7533; Executive Order (E.O.) 12968, entitled “Access to Classified Information," dated August 2, 1995 as amended; E.O. 13467 entitled “Reforming Processes Related to Suitability for Government Employment, Fitness for Contractor Employees, and Eligibility for Access to Classified National Security Information,” dated July 2, 2008, as amended; E.O 13488, entitled “Granting Reciprocity on Excepted Service and Federal Contractor Employee Fitness and Reinvestigating Individuals in Positions of Public Trust,” dated January 16, 2009; E.O. 13526, entitled “Classified National Security Information,” dated December 29, 2009; and any other applicable authorities. The program shall be applicable throughout the Department and located within the Office of Terrorism and Financial Intelligence, pursuant to 31 U.S.C. 312(a)(4).
    2. The Assistant Secretary for Intelligence and Analysis is delegated the authority of the Secretary to exercise and perform all duties, rights, powers, and obligations under the above-referenced authorities. This delegation includes making all determinations and appointments and issuing any regulations required to implement the Department's personnel security program, except for any matter in which, by law, executive order, or regulation the personal decision of the head of the agency or principal deputy is required.
    3. The Assistant Secretary for Intelligence and Analysis is designated as the Department's senior agency official under E.O. 12968, with authority to direct and administer Treasury's personnel security program. The Assistant Secretary for Intelligence and Analysis shall oversee the program and ensure that the functions listed in this order are carried out.
    4. The Assistant Secretary for Intelligence and Analysis is delegated as the official responsible for carrying out instruction and directives issued by the Security Executive Agent, the Director of National Intelligence, and the Suitability Executive Agent, the Office of Personnel Management, under E.O. 13467.
    5. The authority delegated by this Order may be redelegated.

  5. CANCELLATION. Treasury Order 102-17, “Delegation of Authority Concerning the Personnel Security Program,” dated May 2, 1996, is superseded.
