TREASURY ORDER 105-17

DATE:    April 28, 2004

SUBJECT:       Establishment of the Office of Terrorism and Financial Intelligence

  1. DELEGATION OF AUTHORITY.  By virtue of the authority vested in the Secretary of the Treasury, it is ordered that the Office of Terrorism and Financial Intelligence (TFI) is established. 
    1. The Under Secretary (Enforcement) is the head of TFI.  The Under Secretary (Enforcement) shall report to the Secretary through the Deputy Secretary.
    2. The Assistant Secretary (Terrorist Financing) and the Assistant Secretary (Intelligence and Analysis) are within TFI, and each shall report directly to the Under Secretary (Enforcement).
    3. The Office of Terrorist Financing is within TFI and reports to the Assistant Secretary (Terrorist Financing).
    4. The Office of Intelligence and Analysis (OIA) is within TFI and reports to the Assistant Secretary (Intelligence and Analysis).
    5. The Office of Foreign Assets Control (OFAC) and the Executive Office for Asset Forfeiture are within TFI and report to the Under Secretary (Enforcement), who may redelegate such responsibility to the Assistant Secretary (Terrorist Financing).  The Financial Crimes Enforcement Network (FinCEN), a Treasury bureau, reports to the Under Secretary (Enforcement), who may redelegate such responsibility to the Assistant Secretary (Terrorist Financing).    
    6. The functions of TFI include providing policy, strategic, and operational direction to the Department on issues relating to:  terrorist financing; financial crimes, including money laundering, counterfeiting and other offenses threatening the integrity of the financial system; United States economic sanctions programs; implementation of Titles I and II of Public Law 91-508, as amended (the Bank Secrecy Act); other enforcement matters; those intelligence analysis and coordination functions described in section 2 of this order; and the Departments security functions and programs.
  2. THE ASSISTANT SECRETARY (INTELLIGENCE AND ANALYSIS).
    1. The Assistant Secretary (Intelligence and Analysis) shall head the Office of Intelligence and Analysis.  OIA shall be responsible for the receipt, analysis, collation, and dissemination of intelligence and counterintelligence information
      related to the operations and responsibilities of the entire Department, including all components and bureaus of the Department.  OIA has two primary functions:
      1. i.    OIA will build a robust analytical capability on terrorist finance by coordinating and overseeing work involving intelligence analysts in all Treasury components.  OIA will focus on the Departments highest priorities, as well as ensuring that the existing intelligence needs of OFAC and FinCEN are met.
      2. ii.    OIA also will provide intelligence support to senior Treasury officials on a wide range of international economic and other relevant issues.  OIA will carry out the intelligence support functions previously assigned to the former Office of Intelligence Support, serve in a liaison capacity with the intelligence community, and represent the Department in various intelligence-related activities.
    2. The Assistant Secretary (Intelligence and Analysis) will serve as the SOIC (Senior Officer of the Intelligence Community) and represent the Department in intelligence community fora, including but not limited to the National Foreign Intelligence Board committees and the Intelligence Community Management Staff.
  3. DELEGATION. To the extent that any authorities, powers, and responsibilities over enforcement matters previously delegated to the Under Secretary (Enforcement), or the former positions of Assistant Secretary (Enforcement), Assistant Secretary (Enforcement and Operations), or Deputy Assistant Secretary (Terrorist Financing and Financial Crimes), have not been transferred to the Department of Homeland Security, the Department of Justice, or the Assistant Secretary (Tax Policy) (related to the Customs revenue functions or the Alcohol and Tobacco Tax and Trade Bureau), those remaining authorities, powers, and responsibilities are delegated to the Under Secretary (Enforcement).         
  4. REDELEGATION.  The authority delegated by this order may be redelegated.
  5. The Office of Terrorism and Financial Intelligence (including its components) is designated as a law enforcement organization of the Department of the Treasury for purposes of 31 U.S.C. 9703 and other relevant authorities.
  6. AUTHORITIES.    
    1. Title 31, United States Code, section 321(b)
    2. Title 31, United States Code, section 311.
  7. Existing Treasury Orders and Directives, until modified or rescinded, shall be read to conform to this Order.
  8. CANCELLATION. 
    1. Treasury Order 105-16, Establishment of Executive Office for Terrorist Financing and Financial Crimes, and Assignment of Enforcement Functions, dated March 31, 2003, is rescinded.         
  9. OFFICE OF PRIMARY INTEREST.  The Office of Terrorism and Financial Intelligence.
