TREASURY ORDER 105-21

DATE:  October 18, 2021

SUBJECT:  Delegation of Authority Concerning the Industrial Security Program and Representation at the Interagency Security Committee

  1. PURPOSE.  To define the Department’s industrial security program senior agency official under Executive Order (E.O.) 12829 and representative to the Interagency Security Committee under E.O. 12977.
  2. SCOPE.  This Order applies to all bureaus, offices, and organizations in the Department of the Treasury, with the exception of the Offices of Inspector General. The provisions of this Order shall not be construed to interfere with or impede the authorities or independence of the Offices of Inspector General.
  3. POLICY.  Pursuant to the authority vested in the Secretary of the Treasury, including the authority vested by 31 U.S.C. § 321(b), E.O. 12829 of January 6, 1993, National Industrial Security Program, as amended, and E.O. 12977 of October 19, 1995, Interagency Security Committee, as amended, it is ordered that:
    1. The Department shall maintain an industrial security program to fulfill the responsibilities imposed by E.O. 12829 to safeguard classified information that is released to contractors, licensees, and grantees of the Department.
    2. The Department will maintain an agreement with the Executive Agent for the National Industrial Security Program, the Secretary of Defense, on the terms of the responsibilities of the Secretary of Defense to act on behalf of the Treasury, pursuant to operational oversight provisions of E.O. 12829.
    3. The program shall be applicable throughout the Department and located within the Office of Terrorism and Financial Intelligence, pursuant to 31 U.S.C. § 312(a)(4).
    4. The Department will participate in the Interagency Security Committee, as established by E.O. 12977.
  4. DELEGATION
    1. The Assistant Secretary for Intelligence and Analysis is delegated the authority of the Secretary to exercise and perform all duties, rights, powers, and obligations under the above referenced authorities, except for any matter in which, by law, executive order, or regulation of outside agencies, the personal decision of the head of the agency or the principal deputy is required. This delegation includes issuing any regulations required to implement the Department's industrial security program.
    2. The Assistant Secretary for Intelligence and Analysis is designated as the Department's senior agency official under E.O. 12829, with authority to direct and administer Treasury's industrial security program. The Assistant Secretary for Intelligence and Analysis shall ensure that the functions listed in E.O. 12829 are carried out. The Assistant Secretary for Intelligence and Analysis shall serve as the senior Department official for all laws, executive orders and regulations requiring a designated official to oversee industrial security within the Department.
    3. The Assistant Secretary for Intelligence and Analysis is appointed as the Department's representative to the Interagency Security Committee as stated in E.O. 12977.
    4. The authority and appointments delegated by this order may be redelegated.

  6. CANCELLATION.  Treasury Directive 71-08, “Delegation of Authority for Physical Security Programs,” dated April 26, 1999, and Treasury Directive 12-32, “ Delegation of Authority Concerning Personnel Security,” dated November 3, 2000, are superseded.
