Guidance Documents

On October 9, 2019, the President issued Executive Order 13891, and the Office of Management and Budget (OMB) followed with M-20-02, Memorandum for Regulatory Policy Officers at Executive Departments and Agencies and Managing and Executive Directors of Certain Agencies and Commissions.  The Executive Order requires each agency to establish a single, searchable, indexed website that contains, or links to, all of the agencies' respective guidance documents currently in effect. 

Unless expressly authorized by law, guidance documents are not meant to bind the public in any way. Guidance documents issued by the Department of the Treasury that meet the definition of “significant” under the OMB Memo (M-20-02), will be published and the public will have an opportunity to submit comments on the document.

Comment on Significant Guidance Documents

Treasury’s significant guidance documents will be posted to Regulations.gov, where you may read and comment on the guidance. If you have comments on significant guidance documents or would like to request that the Department issue, reconsider, modify, or rescind significant guidance documents, please email us to submit the request.

  • When submitting a comment, please identify the particular guidance document you are addressing and the office or bureau that issued the document.  
  • Requests that a significant guidance document be issued should include a description of the guidance document sought and the need for the guidance.

Public comments under these procedures are for the benefit of the agency and do not require formal response by the agency. The Department will review requests, comments, and questions, determine whether an action is warranted and, if so, what action to take.
